Rules for the Processing of Personal Data for Marketing Purposes within the Capital Group

1. The administrator of your personal data is TRADEA Spółka z ograniczoną odpowiedzialnością, with its registered office in Częstochowa at ul. Mielczarskiego 21/23, 42-202 Częstochowa, registered with the District Court in Częstochowa, XVII Commercial Division of the National Court Register, KRS No. 0000368056, NIP 5732813900, REGON 241750310 (hereinafter TRADEA).

2. TRADEA has appointed a Data Protection Officer who can be contacted via email at odo1@unimot.pl or at TRADEA’s office address with the note “Data Protection Officer.”

3. Personal data will be processed:  
  a) for the purpose specified in each individual consent (Article 6(1)(a) of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (GDPR));  
  b) to pursue TRADEA’s legitimate interest in the potential establishment, exercise, or defense of claims (Article 6(1)(f) of GDPR).

4. Personal data will be transferred to:  
  a) entities providing services necessary for the purpose of data processing, such as advertising, marketing, and legal services;  
  b) providers of IT systems and IT services (including hosting, maintenance, and software development companies);  
  c) entities within the UNIMOT Capital Group.

5. Personal data will be processed until:  
  a) consent is withdrawn;  
  b) mutual claims expire, in the case of data processed based on TRADEA’s legitimate interest.

6. You have the right to access your data, request its rectification, deletion, restriction of processing, data portability, and the right to object to data processing. These rights can be exercised by submitting a relevant request to the Data Protection Officer.

7. You also have the right to lodge a complaint with the supervisory authority responsible for personal data protection (President of the Personal Data Protection Office) if you believe that the processing of your personal data violates GDPR provisions.

8. Providing personal data is voluntary, but necessary to receive messages of a specified nature.

Rules for the Processing of Personal Data Before Entering into a Cooperation Agreement

1. The administrator of your personal data is TRADEA Spółka z ograniczoną odpowiedzialnością, with its registered office in Częstochowa at ul. Mielczarskiego 21/23, 42-202 Częstochowa, registered with the District Court in Częstochowa, XVII Commercial Division of the National Court Register, KRS No. 0000368056, NIP 5732813900, REGON 241750310 (hereinafter TRADEA).

2. TRADEA has appointed a Data Protection Officer who can be contacted via email at odo1@unimot.pl or at TRADEA’s office address with the note “Data Protection Officer.”

3. Personal data will be processed:  
  a) to take actions leading to the conclusion of a contract by preparing a cooperation offer (Article 6(1)(b) of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (GDPR));  
  b) to pursue TRADEA’s legitimate interest in the potential establishment, exercise, or defense of claims (Article 6(1)(f) of GDPR);  
  c) for purposes specified in each individual consent (Article 6(1)(a) of GDPR);  
  d) to fulfill TRADEA’s legal obligations under generally applicable law, including tax and accounting regulations (Article 6(1)(c) of GDPR).

4. Personal data will be transferred to:  
  a) entities providing services necessary to take actions aimed at concluding a contract, such as accounting services, invoicing, contract settlement, contract brokerage, legal services, business intelligence, insurance companies, and companies verifying and securing trade credit limits;  
  b) providers of IT systems and IT services (including hosting, maintenance, and software development companies);  
  c) entities within the UNIMOT Capital Group.

5. Your personal data will be processed for the period:  
  a) necessary to conclude the contract;  
  b) in the event of contract conclusion – for the duration of the contract;  
  c) until consent is withdrawn;  
  d) until an objection is raised, in the case of data processed under TRADEA’s legitimate interest.

6. You have the right to access your data, request its rectification, deletion, restriction of processing, data portability, and the right to object to data processing. These rights can be exercised by submitting a relevant request to the Data Protection Officer.

7. You also have the right to lodge a complaint with the supervisory authority responsible for personal data protection (President of the Personal Data Protection Office) if you believe that the processing of your personal data violates GDPR provisions.

8. Providing personal data is voluntary, but necessary to conclude the contract and to take actions towards its conclusion. Failure to provide the personal data required by TRADEA will result in the inability to conclude the contract and take actions towards its conclusion.

Rules for the Processing of Personal Data for Individuals Receiving a Commercial Offer

  a) to respond to a query submitted directly to TRADEA’s email address or through the use of forms (Article 6(1)(f) of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (GDPR));  
  b) to pursue TRADEA’s legitimate interest in the potential establishment, exercise, or defense of claims (Article 6(1)(f) of GDPR).

3. Personal data will be processed:  
  a) for the purpose of contract execution (Article 6(1)(b) of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (GDPR));  
  b) to fulfill legal obligations imposed on TRADEA by generally applicable laws, including tax and accounting regulations (Article 6(1)(c) of GDPR);  
  c) to pursue TRADEA’s legitimate interest in the potential establishment, exercise, or defense of claims (Article 6(1)(f) of GDPR).

4. Personal data will be transferred to:  
  a) entities providing services necessary for the purpose of data processing, such as advertising, marketing, and legal services;  
  b) providers of IT systems and IT services (including hosting, maintenance, and software development companies);  
  c) entities within the UNIMOT Capital Group.

5. Personal data will be processed for the period:  
  a) of the contract duration. The processing period may be extended by the limitation period for claims, if necessary for TRADEA to establish, exercise, or defend against claims. After this period, data will be processed only to the extent and for the duration required by law, including accounting regulations;  
  b) until an objection is raised, in the case of data processed under TRADEA’s legitimate interest.

6. You have the right to access your data, request its rectification, deletion, restriction of processing, data portability, and the right to object to data processing. These rights can be exercised by submitting a relevant request to the Data Protection Officer.

7. You also have the right to lodge a complaint with the supervisory authority responsible for personal data protection (President of the Personal Data Protection Office) if you believe that the processing of your personal data violates GDPR provisions.

Rules for the Processing of Personal Data for Job Applicants

1. The administrator of your personal data is TRADEA Spółka z ograniczoną odpowiedzialnością, with its registered office in Częstochowa at ul. Mielczarskiego 21/23, 42-202 Częstochowa, registered with the District Court in Częstochowa, XVII Commercial Division of the National Court Register, KRS No. 0000368056, NIP 5732813900, REGON 241750310 (hereinafter TRADEA).

2. TRADEA has appointed a Data Protection Officer who can be contacted via email at odo1@unimot.pl or at TRADEA’s office address with the note “Data Protection Officer.”

3. Personal data will be processed:  
  a) to fulfill the legal obligation imposed on TRADEA based on Article 22¹ § 1-2 of the Labor Code (Article 6(1)(c) of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (GDPR));  
  b) based on voluntary consent for data not required by law (Article 6(1)(a) of GDPR);  
  c) based on voluntary consent for processing personal data in future recruitment processes (Article 6(1)(a) of GDPR).

4. Personal data will be transferred to:  
  a) entities providing services necessary for actions aimed at concluding an agreement with you, such as accounting, HR, and legal services;  
  b) providers of IT systems and IT services (including hosting, maintenance, and software development companies);  
  c) entities within the Unimot Capital Group.

5. Personal data will be processed for the period:  
  a) of the recruitment process, but not longer than 12 months from the date of application submission;  
  b) until the consent is withdrawn.

6. You have the right to access your data, request its rectification, deletion, restriction of processing, data portability, and the right to object to data processing. These rights can be exercised by submitting a relevant request to the Data Protection Officer.

7. You also have the right to lodge a complaint with the supervisory authority responsible for personal data protection (President of the Personal Data Protection Office) if you believe that the processing of your personal data violates GDPR provisions.

8. Providing personal data is voluntary, but necessary to participate in the recruitment process. Failure to provide the personal data required by TRADEA will result in the inability to participate in the recruitment process.

Rules for Processing Personal Data of Representatives

1. The administrator of your personal data provided for the purpose of concluding and executing the agreement is TRADEA Spółka z ograniczoną odpowiedzialnością, with its registered office in Częstochowa at ul. Mielczarskiego 21/23, 42-202 Częstochowa, registered with the District Court in Częstochowa, XVII Commercial Division of the National Court Register, KRS No. 0000368056, NIP 5732813900, REGON 241750310 (hereinafter Tradea).

2. Tradea has appointed a Data Protection Officer who can be contacted via email at odo1@unimot.pl or at Tradea’s office address with the note “Data Protection Officer.”

3. Your personal data was obtained by Tradea in connection with the conclusion and execution of the agreement, depending on the type of cooperation, including: data necessary for representing a legal entity, contact data, and data contained in documents confirming your qualifications, experience, or products resulting from the agreement’s execution.

4. Depending on the type of cooperation, your personal data may be processed for the following purposes:  
  a) to execute the agreement with Tradea, involving verification of representations made by the aforementioned entity, including confirming relevant authorizations and qualifications of persons indicated to perform the agreement, contact for contract execution, correspondence exchange, proper performance of the agreement, control, settlement, confidentiality, as well as health and safety obligations;  
  b) to handle, pursue, and defend claims between Tradea and you or Tradea and the aforementioned entity;  
  c) to fulfill legal obligations imposed on Tradea.

5. The legal basis for processing your personal data, depending on the type of cooperation and for the purposes specified in point 4, is:  
  a) legitimate interest (Article 6(1)(f) of GDPR), allowing correct and effective execution of the agreement between Tradea and the aforementioned entity;  
  b) legal obligations (Article 6(1)(c) of GDPR) imposed on Tradea;  
  c) legitimate interest of Tradea (Article 6(1)(f) of GDPR), involving claims pursuit or defense.

6. The scope of processed personal data may include, depending on the function and cooperation scope, data such as: name, position, function, business phone number, business email address, PESEL number, and information on authorizations and qualifications.

7. Your personal data may be disclosed to the following categories of recipients:  
  a) entities processing personal data on behalf of Tradea, including those managing IT systems necessary for agreement execution, providing financial-accounting services, or archiving and servicing services;  
  b) entities providing services to Tradea, including courier and postal companies (for required notifications specified in the agreement), Distribution System Operators (DSOs), Transmission System Operators (TSOs), legal and financial advisors, and auditors of both parties (for advice on agreement conclusion, execution, and claim enforcement);  
  c) entities within the Unimot Capital Group.

8. Your personal data will be processed for the duration of the agreement and for the period necessary to fulfill legitimate interests and legal obligations. The processing period may be extended only if and to the extent required by law.

9. You have the following rights related to the processing of personal data:  
  a) the right to access your data;  
  b) the right to rectify personal data;  
  c) the right to delete personal data or restrict processing;  
  d) the right to object in cases where processing is based on the legitimate interest of Tradea; objections may be made on the basis of a specific situation.

10. To exercise the above rights, please contact Tradea at the address specified in point 1.

11. Each individual also has the right to file a complaint with the supervisory authority (in Poland, this is the President of the Personal Data Protection Office).

12. Personal data will not be subject to profiling or automated decision-making.
