Unimot System

Unimot System Sp. z o.o. processes personal data in compliance with the applicable law, particularly with the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons concerning the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation or GDPR).

Principles of processing personal data for marketing purposes within the Group

1. The controller of your personal data is Unimot System Sp. z o.o., headquartered in Warsaw (address: Aleje Jerozolimskie 142a, 02-305, Warsaw), a company registered in the Register of Entrepreneurs of the National Court Register under number KRS 0000414578, by the District Court for the Capital City of Warsaw, XII Commercial Division of the National Court Register, NIP 7010337526, REGON 146062054 (hereinafter referred to as UNIMOT).

2. UNIMOT has appointed a Data Protection Officer who can be contacted at odo1@unimot.pl or by sending correspondence to UNIMOT with the note "Data Protection Officer."

3. Your personal data will be processed for the following purposes: (1) to achieve the purpose specified each time in the content of consent (Art. 6(1)(a) of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons concerning the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (GDPR)), and (2) to establish, pursue, or defend claims, which constitutes the legitimate interest of UNIMOT (Art. 6(1)(f) GDPR).

4. Your personal data may be transferred to (1) entities providing services for UNIMOT necessary to achieve the purpose for which the data is processed, such as advertising, marketing, and legal services; (2) providers of IT systems and services, including hosting, maintenance, and programming; and (3) entities within the UNIMOT Capital Group.

5. Your personal data will be processed until (1) consent is withdrawn, or (2) mutual claims expire in the case of data processed on the basis of UNIMOT's legitimate interest.

6. You have the right to access your data, request its correction, deletion, or restriction of processing, and the right to data portability as well as the right to object to the processing of your data. These rights can be exercised by submitting an appropriate request to the Data Protection Officer.

7. You also have the right to file a complaint with the supervisory authority for the protection of personal data (President of the Personal Data Protection Office) if you believe that the processing of your personal data violates the GDPR provisions.

Rules for Processing Personal Data Prior to Entering into a Cooperation Agreement

1. The controller of your personal data is Unimot System Sp. z o.o., headquartered in Warsaw (address: Aleje Jerozolimskie 142a, 02-305, Warsaw), a company registered in the Register of Entrepreneurs of the National Court Register under number KRS 0000414578, by the District Court for the Capital City of Warsaw, XII Commercial Division of the National Court Register, NIP 7010337526, REGON 146062054 (hereinafter referred to as UNIMOT).

2. UNIMOT has appointed a Data Protection Officer who can be contacted at odo1@unimot.pl or by sending correspondence to UNIMOT with the note "Data Protection Officer."

3. Your personal data will be processed: (1) to take actions leading to the conclusion of an agreement through the preparation of a cooperation offer (Art. 6(1)(b) of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons concerning the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (GDPR)), (2) to establish, pursue, or defend claims, which constitutes the legitimate interest of UNIMOT (Art. 6(1)(f) GDPR), (3) to fulfill the purpose specified in each consent (Art. 6(1)(a) GDPR), and (4) to comply with legal obligations imposed on UNIMOT under generally applicable laws, including tax and accounting regulations (Art. 6(1)(c) GDPR).

Your personal data may be transferred to: (1) entities providing services for UNIMOT necessary for taking actions to conclude an agreement, such as accounting services, invoicing, contract settlements, brokerage, legal services, economic intelligence, insurance companies, and companies verifying and securing credit limits; (2) providers of IT systems and services, including hosting, maintenance, and programming; and (3) entities within the UNIMOT Capital Group.

5. Your personal data will be processed for the period: (1) necessary to conclude an agreement; (2) in the event of concluding an agreement, for the duration of the agreement; (3) until consent is withdrawn; or (4) until an objection is lodged, in the case of data processed under the legitimate interest of UNIMOT.

6. You have the right to access the content of your data and request its rectification, erasure, restriction of processing, data portability, and the right to object to processing. The exercise of rights is done by submitting a request to the Data Protection Officer.

7. You also have the right to lodge a complaint with the supervisory authority responsible for personal data protection (the President of the Personal Data Protection Office) if you believe that the processing of your personal data violates GDPR.

8. Providing personal data is voluntary but necessary for concluding an agreement and taking actions towards its conclusion. The consequence of not providing the personal data required by UNIMOT is the inability to conclude the agreement and take actions towards its conclusion.

Rules for Processing Personal Data of Individuals Receiving a Commercial Offer

1. 1. 5. Your personal data will be processed for the period: (1) of the contract duration. The period of processing may be extended by the limitation period of any claims if processing is necessary to pursue any claims or defend against them by UNIMOT. After this period, the data will be processed only to the extent and for the time required by law, including accounting regulations; or (2) until an objection is lodged, in the case of data processed under the legitimate interest of UNIMOT.

Rules for Processing Personal Data of Job Applicants

1. Your personal data may be transferred to: (1) entities providing services for UNIMOT necessary for taking actions aimed at concluding an agreement with you, such as accounting, HR, and legal services; (2) providers of IT systems and services, including hosting, maintenance, and programming; and (3) entities within the Unimot Capital Group.

5. Your personal data will be processed for the period: (1) of the recruitment process, but no longer than 12 months from the date of application submission; or (2) until consent is withdrawn.

6. You have the right to access the content of your data and request its rectification, erasure, restriction of processing, data portability, and the right to object to processing. The exercise of rights is done by submitting a request to the Data Protection Officer.

7. You also have the right to lodge a complaint with the supervisory authority responsible for personal data protection (the President of the Personal Data Protection Office) if you believe that the processing of your personal data violates GDPR.

8. Providing personal data is voluntary but necessary to participate in the recruitment process. The consequence of not providing the personal data required by UNIMOT is the inability to participate in the recruitment process.

Rules for Processing Personal Data of Representatives

1. The controller of your personal data provided for the purpose of concluding and executing an agreement is Unimot System Sp. z o.o., headquartered in Warsaw (address: Aleje Jerozolimskie 142a, 02-305, Warsaw), a company registered in the Register of Entrepreneurs of the National Court Register under number KRS 0000414578, by the District Court for the Capital City of Warsaw, XII Commercial Division of the National Court Register, NIP 7010337526, REGON 146062054 (hereinafter referred to as UNIMOT).

2. UNIMOT has appointed a Data Protection Officer who can be contacted at odo1@unimot.pl or by sending correspondence to UNIMOT with the note "Data Protection Officer."

3. Your personal data has been obtained by UNIMOT in connection with the conclusion and execution of an agreement, depending on the type of cooperation, including data necessary for representing a legal entity, contact information, data contained in documents in your possession confirming qualifications, experience, or constituting a product of the agreement's execution.

4. Your personal data may be processed depending on the type of cooperation, for the following purposes: (1) to execute the agreement with UNIMOT, of which the entity providing the data is a party, particularly for verifying statements made by said entity, including confirmation of the qualifications of persons indicated for executing the agreement, communication during the performance of the agreement, correspondence exchange, proper execution of the agreement, control, settlement, confidentiality maintenance, and ensuring safety and occupational hygiene; (2) for handling, pursuing, and defending claims, including those between UNIMOT and you or between UNIMOT and the aforementioned entity; and (3) for complying with the legal obligations imposed on UNIMOT.

5. The legal basis for processing your personal data, depending on the type of cooperation, for the purposes indicated in point 4 above is: (1) the legitimate interest (Art. 6(1)(f) GDPR) of ensuring proper and efficient performance of the agreement between UNIMOT and the aforementioned entity; (2) compliance with legal obligations (Art. 6(1)(c) GDPR) imposed on UNIMOT; and (3) the legitimate interest of UNIMOT (Art. 6(1)(f) GDPR) in pursuing or defending against claims.

6. The scope of the personal data processed may include, depending on the role and scope of cooperation, information such as your name, position, function, business phone number, business email address, PESEL number, and details on qualifications and competencies.

7. Your personal data may be transferred to the following categories of recipients: (1) entities processing personal data on behalf of UNIMOT, including, but not limited to, those maintaining IT systems used for agreement implementation, providing financial and accounting services, or offering archiving and maintenance services; (2) entities providing services to UNIMOT, including courier and postal companies (in connection with the need to make notifications specified in the agreement), legal and financial advisors, and auditors of the parties (in connection with providing advisory services related to the conclusion, execution, and enforcement of claims under the agreement); and (3) entities within the Unimot Capital Group.

8. Your personal data is processed for the duration of the agreement, as well as the time necessary to realize legitimate interests and perform obligations under the law. The processing period may be extended only if and to the extent required by law.

9. You have the following rights related to the processing of personal data: (1) the right to access your data; (2) the right to rectify your personal data; (3) the right to erase or restrict the processing of personal data; and (4) the right to object—in cases where processing is based on the legitimate interest of UNIMOT. You may object based on a specific situation.

10. To exercise these rights, you must contact UNIMOT at the address specified in point 1.

11. You also have the right to lodge a complaint with the supervisory authority (in Poland, this is the President of the Personal Data Protection Office).
